S.1728 was the companion bill to HR 3590. It was enrolled on Sept. 30, 2009 as the Senate counterpart to the House version of the Service Members Home Ownership Act of 2009. This bill, which was passed in the House, died in the Senate. When Obamacare was accepted for arguments in the Supreme Court, Congress was obligated to prove to the High Court that Obamacare originated in the House. Sen. Harry Reid gutted HR 3590, removing the language of the Service Members Home Mortgage Ownership Act of 2009 and substituted the language found in HR 3962.

When you use Google, Bing, Yahoo or your favorite search engine for HR 3590, it will pull up only links to Obamacare. The scrubbing was pretty much complete—unless you search for the Service Members Home Mortgage Ownership Act of 2009 or S.1728. The links are getting more scarce, but a search to the Library of Congress pulled the above link. When you look at it closely, you will see the original form of HR 3590—and it isn't Obamacare.
